There is no single sick-leave law for cancer in India. What you can take depends on your employer. Government staff have service rules with longer leave for cancer. ESI members can claim part of their wages, including extended benefit for up to two years. Private staff rely on company policy and state law. The short answer
How much leave can you take for a blood cancer in India?
There is no single national law that gives every worker a fixed number of sick days for cancer. Your leave depends on who employs you: the government, a private company covered by ESI, a private company that is not, or nobody at all.
Why that matters for a blood cancer
Many blood cancers are treated over months, and some over years. A few days of sick leave will not cover a course of chemotherapy, the weeks when your blood counts are low, or a transplant at another centre. So the real question is which rules stack on top of each other, and in what order you use them.
Where your rights actually come from
Most employees have rights from three places at once. The first is your appointment letter and the company leave policy. The second is the law for your type of workplace, such as your state's Shops and Establishments Act or the standing orders of a factory. The third is a social security scheme like ESI, or the service rules if you work for the government.
Ask HR for the leave policy in writing before you apply. It is far easier to plan months of treatment from a document than from a conversation.Find your situation

Central or state government
Service rules give you earned leave, half pay leave and commuted leave. Cancer is one of the few illnesses for which the rules allow a longer stretch of extraordinary leave than usual.

Private job with ESI
If ESI is cut from your salary, ESIC pays sickness benefit at 70% of your wages for up to ninety-one days a year. Cancer is on the list for extended sickness benefit, at 80% of wages for up to two years.
You need a minimum period of contributions first.Private job without ESI
Your company policy and your state's Shops and Establishments Act set the minimum paid sick and casual leave. Beyond that, most companies allow unpaid leave on request.
Daily wage or self-employed
There is usually no paid leave at all. The protection has to come from health schemes, savings and family support instead.

In what order should you use your leave?

Get the treatment plan in writing
Ask your haematologist how long treatment is likely to last and which weeks carry the most risk of infection. A rough outline is enough to plan with. It will change, and that is normal.

Use paid sick and casual leave first
These are usually lost at the end of the year anyway. Attach a medical certificate from your treating doctor to every application.

Move to earned or privilege leave
This is paid and often carries over between years.

Claim ESI benefit or commuted leave
ESI members apply to their ESIC branch office. Government staff can convert half pay leave into commuted leave on a medical certificate.

Ask for unpaid or extraordinary leave
Put the request in writing with an expected return date, and keep the reply.

Return with a fitness certificate
Most employers ask for one. Ask your doctor to note any limits, such as avoiding crowded sites while your counts recover.

What do the leave words on your letter mean?
- Casual leave
- A few short days for sudden needs. It rarely carries over to the next year.
- Earned or privilege leave
- Paid leave you build up by working. It often carries over and can sometimes be paid out when you leave.
- Commuted leave
- A government rule that turns two days of half pay leave into one day of full pay, on a medical certificate.
- Extraordinary leave
- Government leave with no pay, used when other leave has run out. Your job stays yours.
- Loss of pay
- Unpaid days in a private job. Your salary for those days is cut, but you are still employed.
- Fitness certificate
- A note from your doctor saying you are well enough to go back to work, and on what terms.
Commonly believed
What do people wrongly assume about leave and cancer?
Some employers do handle it badly. But leave taken on a proper medical certificate is hard to hold against you. Unexplained absences are what put jobs at risk.
ESI has two sides. One is treatment. The other is cash benefit that replaces part of your wages while you cannot work. Many members never claim the second part because nobody told them it exists.
Talk to HR early. Some companies offer shorter days, work from home or a lighter role during treatment. Those options are easier to arrange before your leave runs out than after.
Most employers accept a certificate from any registered doctor. ESIC may ask for its own forms or its own doctor to confirm. Check before you apply so the claim is not delayed.

Can a son, daughter or spouse take leave to care for you?
There is no general law in India that gives carers paid leave in a private job. What a family member gets depends on their own employer's policy, so they should ask their HR directly.
What often helps
Many companies allow earned leave, work from home or flexible hours for a carer if asked. Hospital days, the first cycles of chemotherapy and any transplant admission are where a second adult matters most. Plan the family's leave around those weeks, not spread evenly.
Government employees who care for a child
Central government service rules include child care leave, which can be used when a child is ill. The conditions are set out in the rules and change from time to time, so check the current version with the office before applying.

What can this page not tell you?
This page cannot tell you exactly how many days you are owed. That sits in your appointment letter, your company policy and the rules for your state and sector. Laws and scheme rules also change, so treat this as a map, not legal advice.
If you think your rights are being ignored
Write to HR and keep copies of every letter and certificate. If you are an ESI member, the ESIC branch office can explain a refused claim. For a dispute about dismissal or unpaid wages, the office of the labour commissioner in your district is the place to start, and a labour lawyer can advise on your own case.
What the treating team can do
Your haematology team can write medical certificates, treatment schedules and fitness notes. Ask for them at the start, not the week your leave runs out. They cannot argue your case with your employer, but a clear letter usually does more than a phone call.

Common questions about medical leave for cancer
Can my employer dismiss me while I am on sick leave?
Dismissing someone only because they are ill is hard to defend, especially when leave was approved on a medical certificate. The exact protection depends on your role and the law for your workplace. Government employees have stronger protection. If you receive a notice, do not sign anything at once. Get advice from a labour lawyer or the labour office first.
Do I have to tell my employer that it is cancer?
You need to give a medical reason for long leave, and a certificate usually states the illness. How much more you share is your choice. Many people tell HR and their direct manager only. Our page on telling an employer about a blood cancer walks through what to say and what you can keep private.
How do I claim ESI sickness benefit?
Get a medical certificate on the ESIC form from an ESI dispensary or hospital doctor, and submit it to your ESIC branch office. For extended sickness benefit for cancer, a specialist recommendation is usually needed too. Keep your insurance number and bank details ready, and ask the branch which forms apply to you.
What if I work on contract or through an agency?
Contract and agency workers are often covered by ESI through the agency, even if the company where you work does not pay you directly. Check your payslip for an ESI deduction. If there is none, ask the agency in writing what leave you have and whether you are insured.
Can I work part-time during treatment instead?
Many people do, if the company agrees. There is no legal right to it in most private jobs, so it is a request, not an entitlement. It works better during some phases of treatment than others. Ask your haematologist which weeks are safer for work, then take a written plan to HR.
Will my salary stop once leave runs out?
In most private jobs, yes, unless ESI or a company policy pays something. Look at group health and income cover through your employer, which some staff do not know they have. Our page on managing money across long treatment covers planning for months when income drops.
Does leave for treatment in another city count the same?
Yes. Leave rules look at the medical reason, not where you are treated. If you travel for a transplant or a specialist opinion, ask that centre for a certificate with the dates of admission and discharge. Attach it to your leave application so the dates match your absence.
