If an insurer or employer has treated you unfairly because of a genetic result, start with a written complaint to them, not with a lawyer. Most insurance disputes can then go to the Insurance Ombudsman free of charge. This page explains who can help, the order to approach them in, what papers to gather, and where free legal aid is available in Telangana. The short answer
What should you do first if you are treated unfairly over a genetic result?
Put the problem in writing and send it to whoever made the decision. For an insurer, that means its grievance officer. For an employer, it means human resources, in a letter or email you keep a copy of. Most insurance disputes are settled at this stage or at the Insurance Ombudsman, and neither step needs a lawyer.
Why the written complaint comes first
The Insurance Ombudsman will only take your case after the insurer has had a chance to answer it. A written complaint also fixes the date the dispute began, which starts the time limits. Ask the insurer to give its reason in writing and to quote the exact policy clause it relies on.
Where employment is different
India has no law that stops a private employer asking about genetic tests. Government employers are bound by the right to equality in Article 14 of the Constitution, so a complaint against them can rest on that. In a private job, your contract and ordinary employment law are what you have. An advocate who handles labour matters is the right first call.
A genetic result is private medical information. Before you share it to settle a dispute, ask who else will see it.Who can help

These are different doors. Each one handles a different kind of problem, and some must be tried first.
The insurer's grievance officer
Every insurer must have a named grievance officer. Write to them first. Then log the same complaint on Bima Bharosa, the grievance portal run by IRDAI, so there is an official record the regulator can see.

The Insurance Ombudsman
A free, independent office for disputes between policyholders and insurers. The Hyderabad office covers Telangana and Andhra Pradesh. You can present your own case in writing, without an advocate, and hearings are informal.

The District Consumer Commission
A consumer court set up under the Consumer Protection Act. It suits disputes the ombudsman cannot take, larger claims, and claims for compensation for stress and delay. You may argue your own case, though most people use an advocate.
Legal services authorities
Every district in Telangana has a District Legal Services Authority that gives free legal advice and, for people who qualify, a free advocate. Women, children, members of Scheduled Castes and Scheduled Tribes, people with disabilities and people below an income limit are among those who qualify.

What order should you raise a complaint in?
Gather the paper trail
Collect the policy wording, your proposal form, the rejection letter, every bill and discharge summary, and your genetic report. If you have no copy of the proposal form, ask the insurer for one.
Get a medical letter
Ask the doctor or counsellor who ordered the test for a short letter. It should say what the test was, when it was done, and whether you had any diagnosis at that time. Carrying a gene fault is not the same as having cancer, and the letter should say so plainly.
Write to the insurer
Set out the facts, the decision you disagree with and what you want done. Send it to the grievance officer, log it on Bima Bharosa and keep the acknowledgement.
Escalate if the answer is poor
If the reply does not resolve it, or no reply comes within a month, take it to the Insurance Ombudsman. File within one year of the insurer's final answer.
Take advice before any court step
If the ombudsman route is closed, or you reject its award, speak to an advocate about the consumer commission. A consumer complaint generally has to be filed within two years of the dispute arising.

The terms you will see, in plain language
- Repudiation
- The insurer's formal refusal to pay a claim, or to honour the policy at all. A repudiation letter must give its reasons.
- Material fact
- Information that would have changed the insurer's decision to offer cover, or its price. Disputes often turn on whether you were ever asked about it.
- Pre-existing disease
- An illness diagnosed or treated within a set period before the policy began. Whether a genetic result on its own counts as one is what many of these disputes are about.
- Insurance Ombudsman
- An independent officer who decides policyholder complaints free of charge. Once you accept the award, the insurer must follow it.
- Grievance officer
- The named person at each insurer who is responsible for handling complaints.
- Legal aid
- Free legal advice or representation, arranged through the legal services authorities for people who qualify.

What this page cannot tell you
It cannot tell you whether you have a case. That depends on the exact questions on your proposal form, what you knew when you signed it, your policy wording and the dates in your medical file. Only an advocate who has read those papers can judge it. An hour of their time before you commit to a long dispute is usually money well spent.
It cannot interpret your result
What your specific variant means is a question for the counsellor who ordered the test. A complaint built on a misreading of the result tends to fail. Get the medical facts right before you argue the legal ones.
Who this does not apply to
Most people who have a genetic test never face a dispute at all. If your insurer has paid your claims and your employer neither knows nor asks, there is nothing to act on. Keep your papers in order in case that changes.

Four things families assume, and what is actually true
Most insurance complaints start with a letter you can write yourself. The ombudsman is free and was designed for people without advocates. Paid legal help matters more if the case moves to a consumer commission or a court.
It is the insurer's position, not the last word. Insurers do reverse decisions after a grievance complaint, and the ombudsman can overrule them. Ask for the reasons in writing.
It does not. Protection comes from the Constitution, a Delhi High Court ruling on genetic exclusions, and the insurance regulator's rules. That patchwork is why the facts of your own case matter so much.
A complaint is not a lawful reason to cancel a policy. Insurers can end a health policy only on narrow grounds, such as proven fraud. Keep paying premiums on time while the dispute runs.

Common questions about legal help
Can I go straight to the Insurance Ombudsman?
No. You must first complain to the insurer in writing. If the insurer rejects your complaint, gives an answer you are unhappy with, or does not reply within a month, you can then approach the ombudsman. Do it within one year of the insurer's reply.
Does the ombudsman charge anything?
No. There is no fee and you do not need an advocate. You can file online through the Council for Insurance Ombudsmen or in person at the Hyderabad office, which covers Telangana and Andhra Pradesh. Hearings are informal, and you can explain your case in your own words.
How do I get a free lawyer?
Contact the District Legal Services Authority, usually based at the district court complex. It gives free advice to anyone and free representation to people who qualify. Some law colleges also run legal aid clinics that can help you draft a complaint letter.
What should the letter from my doctor say?
Which test was done, on what date, and what it showed in general terms. It should also say whether you had any diagnosis, symptoms or treatment at that time. It should not give an opinion on the dispute itself. Facts from your doctor carry weight because they come from the medical record.
My employer asked for my genetic report. Must I give it?
No Indian law specifically requires you to hand it to a private employer, and none specifically stops them asking. Ask in writing why they want it and how it will be stored. Then take advice from an advocate who handles labour matters before you decide.
How long does a complaint take?
Insurers are expected to resolve grievances within about two weeks under IRDAI rules. The ombudsman aims to decide within about three months of receiving all your papers. Consumer commission cases usually take longer, which is one reason most people try the ombudsman first.
Is it worth fighting a small claim?
Often, yes, because the grievance and ombudsman steps cost nothing but your time. A rejection left unchallenged can also shape how your next claim is handled. Weigh the effort against the amount, and against what the decision might mean for future claims.
