Sick leave and your rights at work during liver cancer treatment | CION Cancer Clinics
Most people in salaried jobs in India can take sick leave for liver cancer treatment, but the amount depends on your employer, your contract and the law that covers your workplace. There is no single cancer leave for everyone. This page explains the kinds of leave you may have, how to ask for them in writing, and who to ask when you are unsure. It is general information, not legal advice. At CION Cancer Clinics, our team supports patients and families through symptoms, follow-up and life during and after treatment.

The short answer
Can I take sick leave for liver cancer treatment in India?
Yes, in most jobs you can, but what you are entitled to depends on who employs you, not on the illness. Your leave comes from your employment contract, your company's leave policy, the labour law that covers your workplace and, if you are insured under it, the Employees' State Insurance scheme.
Why the answer is different for everyone
India has no single law that gives every cancer patient a fixed amount of paid leave. A central government employee, a factory worker covered by ESI, a software engineer in a private company and a shop assistant in Warangal all sit under different rules. Many people in informal work have no paid leave at all and rely on unpaid time off and family support.
What liver cancer adds to the picture
Liver cancer treatment rarely happens in one block. There are scans, tumour board reviews, procedures such as TACE, cycles of immunotherapy or tablets, and regular follow-up for the liver itself. That means many short absences spread over months, which suits some leave policies better than others. Our page on working during treatment covers the practical side of staying at work.
This page is general information, not legal advice. Your HR department, your union or a labour lawyer can tell you what applies to your job.Where leave comes from
Which kinds of leave might I be able to use?
Most people have more than one source of leave. Look at all of them together before you decide how to use any one.
Your employer's leave policy
Private companies set sick, casual and earned leave in the appointment letter or HR policy. Many allow earned leave to be carried forward or, in some firms, donated by colleagues. Ask HR for the written policy rather than relying on what a manager remembers.
State labour law
Factories, shops and establishments are covered by central and state labour laws, including the Telangana and Andhra Pradesh shops and establishments rules. These set a minimum for sick and casual leave. Your employer can give more, but should not give less.
ESI sickness benefit
If you are insured under the Employees' State Insurance scheme, you may receive a cash sickness benefit while certified unfit for work. ESI also has an extended sickness benefit for certain long-term illnesses, and cancer is among them. The rules on eligibility change, so check with your ESI branch office.
Government service rules
Central and state government employees have leave set by their service rules, which usually include commuted and extraordinary leave for serious illness. The office establishment section can tell you exactly what you have.
If none of these apply
- Ask for unpaid leave in writing
- Ask about part-time or flexible hours
- Speak to the CION team about timing treatment around work
Not sure whether this applies to you?
Ask an oncologistDoing it in order
How do I ask for sick leave without putting my job at risk?
Read the policy first
Get a copy of your leave policy and appointment letter. Note how much of each type you have left, and whether leave needs approval in advance.
Ask your doctor for a medical certificate
Your oncologist can give a certificate that says you are under treatment and need time off. It does not have to name the diagnosis if you would rather keep that private. Ask for one each time leave is needed.
Put the request in writing
Send a short email or letter to your manager and HR with the dates and the certificate attached. Keep a copy. Written requests protect you far better than a conversation in the corridor.
Plan the next few months, not just next week
Ask your treating team for a rough treatment calendar and share what you are comfortable sharing. Our guide to talking to your employer helps with that conversation.
Get a fitness certificate when you return
Many employers ask for one before you rejoin. Your doctor can also note any adjustments that would help, such as lighter duties or time off for follow-up scans.
Do not push through work if you vomit blood, pass black stools, become newly confused or very drowsy, or have a fever with a swollen, painful abdomen. These can be signs of bleeding varices, hepatic encephalopathy or infected fluid. Go to the nearest hospital today and tell them you have liver cancer. Sort out the leave paperwork afterwards.
Words HR will use
What do the terms on my leave papers mean?
- Medical certificate
- A signed note from a registered doctor saying you are unfit for work for a stated period because of illness or treatment.
- Fitness certificate
- A note saying you are fit to return, sometimes with limits on what work you should do at first.
- Extraordinary or unpaid leave
- Time off without salary, usually granted when paid leave is used up. Your job is normally kept for you while it lasts.
- ESI sickness benefit
- A cash payment from the ESI scheme to an insured worker who is certified unfit for work. It is paid by ESI, not by your employer.
- Reasonable adjustment
- A change to how or when you work so you can keep working, such as flexible hours, work from home or a seat near the washroom.

Commonly believed
What do people wrongly assume about cancer and their job?
Some employers do treat people badly, and that fear is real. But many employers handle it well, and a written record of your illness and leave requests gives you more protection if a dispute ever arises, not less.
Usually you only need to show that you are under medical treatment and unfit for work. How much detail you share is your choice, though sharing a little often makes flexibility easier to arrange.
Resigning can mean losing salary, group health insurance and ESI cover at the moment you need them most. Talk to HR and your family about leave options before you make any decision you cannot undo.
Liver cancer has many causes, including hepatitis B, hepatitis C and fatty liver. Your medical certificate does not need to give a cause, and nobody at work is owed an explanation of one.
Being straight with you
What can this page not tell me about my rights?
It cannot tell you exactly how much leave you are owed. That depends on your contract, your employer's policy, the state you work in and whether you are covered by ESI or government service rules. Rules also change, so check the current version.
Who to ask instead
Your HR department or the establishment section of your office is the first stop. If you are insured under ESI, the local ESI branch office can explain the sickness benefits. A trade union, the state labour department or a lawyer who handles employment cases can help if you think you are being treated unfairly. If you want to look into a disability certificate, see our page on disability certificates and entitlements.
Who this does not apply to
If you run your own business, farm your own land or work daily wages with no employer, most of these leave rules do not reach you. For you the practical questions are about income, schemes and family support, which our page on money worries covers.

Common questions about sick leave and liver cancer
Is there a special cancer leave in India?
There is no single national cancer leave for every worker. Some employers and some government service rules have special provisions for serious illness, and ESI has an extended sickness benefit that includes cancer. Ask HR whether your organisation has a long-illness policy, because many do without advertising it.
Can my employer ask which illness I have?
An employer can ask for proof that you are unwell and under treatment, usually a medical certificate. Many do not need the exact diagnosis. If you are unsure what to share, ask your doctor to write a certificate that says you are under specialist treatment and leave the detail out.
What happens when my paid leave runs out?
Most employers then consider unpaid or extraordinary leave, reduced hours or work from home. Ask for these in writing before your paid leave ends, not after. If you are covered by ESI, ask the branch office whether a sickness benefit can support you during this period.
Can I be dismissed for being off sick with cancer?
The answer depends on your contract, the law covering your workplace and how the absence was handled. Government employees usually have stronger protection under their service rules. If you receive a warning or dismissal letter, keep it and speak to a union or a lawyer before you sign anything.
Can a family member take leave to care for me?
Some employers allow family care leave or let carers use their own sick or earned leave. Government rules have their own provisions. There is no general legal right to carer leave in most private jobs, so your son or daughter should ask their own HR department what is possible.
Will CION give me a medical certificate?
Yes. Your treating oncologist can give a certificate for the time you need off, and a fitness certificate when you are ready to return. Tell the team at your visit which format your employer wants, so you do not need a second trip.
Do I lose my group health insurance if I take long leave?
Usually not while you are still employed, even on unpaid leave, but it depends on the policy. Resigning almost always ends group cover. Ask HR in writing how long leave affects your insurance before you make any decision about stopping work.
Who can help me if I think I am being treated unfairly?
Start with HR, in writing. If that does not help, a trade union, the state labour department or an employment lawyer can advise you. Keep copies of every certificate, email and letter, because a clear paper trail is the strongest thing you can bring to anyone who helps you.
